California Attorney General Rob Bonta is leading a multistate lawsuit against the EPA’s move to revoke the finding that greenhouse gases endanger human health, the basis for federal climate rules. The case could reach the Supreme Court; Bonta said he cannot guarantee a win.
The EPA this month also scrapped a power-plant rule limiting carbon dioxide. Bonta accused Trump of repeatedly offering favors to the fossil-fuel industry and failing to enforce antitrust laws.
In a separate dispute, California is defending Clean Air Act waivers that allow stricter vehicle-emissions limits, supporting its goal of ending new sales of internal-combustion vehicles by 2035. A federal court ruled EPA’s attempt to treat the waivers as rules subject to repeal under the Congressional Review Act was illegal; the agency appealed. A POLITICO poll found 54% of likely voters opposed the 2035 ban.
