Turning Point USA spokesman Andrew Kolvet called attorney Kate Lincoln-Goldfinch and her client, Wilber Rafael Garces Perez, a “perfect match” after her deleted post invoking Charlie Kirk resurfaced. Garces Perez was shot by an ICE officer in Austin.
Her post invoked Charlie Kirk and asked, “How do you resist getting shot in the neck?” She said it was removed because it could be misconstrued. She says Garces Perez was delivering for DoorDash, initially unaware agents were pursuing him, when an unmarked vehicle hit his car. DHS says he had a final removal order, which his lawyer disputes. DHS authenticated footage of at least two federal vehicles following with lights and sirens before the shooting. Austin police video shows officers helping him from the car, contradicting a claim federal agents pulled him out; it does not show the shooting.
Lincoln-Goldfinch’s firm sued to block Garces Perez’s immediate removal. A federal judge ordered him to remain in the country to attend a Sept. 30 hearing. Homeland Security Investigations, with FBI assistance, is leading the federal investigation; Austin authorities have also reviewed evidence.
