Jim Jordan’s 57-page report accuses Jack Smith’s Arctic Frost team of improperly obtaining records tied to as many as 44 lawmakers, including two Democrats, and bypassing legal safeguards. Smith’s lawyer called the report’s premise a mischaracterization.
Jordan’s report says prosecutors used subpoenas and accompanying gag orders to obtain lawmakers’ records without their knowledge for more than two years, despite DOJ Public Integrity Section officials warning that subpoenas could be unconstitutional and noting litigation risks. It also alleges Smith’s team released a large trove of alleged evidence weeks before the 2024 election to sway public opinion. The report says a subpoena to Jordan’s carrier sought every incoming and outgoing call from Jan. 1, 2020, to Apr. 25, 2022, and was served by an inspector-general agent.
Smith testified that Trump was responsible for collecting senators’ records because, he said, Trump directed his co-conspirators to call them to delay proceedings. Smith said his team would have obtained toll records if Trump had called Democratic senators instead. His lawyer said the investigation followed normal DOJ procedures and politics played no role. Jordan urged passage of a bill barring government entities from obtaining records likely to implicate the Speech or Debate Clause; it cleared the House Judiciary Committee but has not received a House floor vote.
