Justice Samuel Alito will not join the Supreme Court’s Oct. 5 hearing on Exxon Mobil and Suncor Energy’s bid to end a Boulder officials’ lawsuit alleging the firms helped fuel climate change. The case could determine the fate of dozens of similar state and local suits.
Boulder officials sued Exxon and Suncor in 2018. Supreme Court clerk Scott Harris notified lawyers for the companies and the officials on Monday, but his letter gave no explanation. Alito owns stock in several oil and gas companies, though not the two defendants; he had initially declined calls from watchdog and environmental groups to recuse himself, but stepped aside when the litigation reached the court in 2023.
