Josue Medina Flores and Christian Gabriel Nunez Petty were arrested and charged with felony assault with hate-crime allegations after prosecutors said they punched a San Jose State student more than two dozen times and struck his friend in an alleged anti-gay attack Sept. 19.
Prosecutors said the attack began around 3:45 a.m. as the student and two female friends crossed campus. Flores and Nunez Petty allegedly asked whether he was gay and shouted slurs before chasing the group. One friend was struck when she tried to shield him; the student was treated at a hospital and released.
University police arrived during the attack and arrested the men as they fled, prosecutors said. Security cameras captured the attack. The men were scheduled to be arraigned Wednesday afternoon in San Jose and face prison time if convicted.
