Hendrick Motorsports seeks to appear in Joe Gibbs Racing’s suit against Spire and asks the court to reject JGR’s second motion to compel discovery, saying additional material sought could expose 42 years of its confidential technical information.
JGR’s discovery requests include Spire’s communications with Hendrick and documents covering Hendrick engines, ECU data, fuel strategy and analysis, pit-road data and flow rates. Hendrick says Spire’s nondisclosure agreement prevents it from sharing the confidential information.
JGR filed the suit in February, alleging former competition director Chris Gabehart breached his contract and took proprietary information to Spire. The case is in discovery, with trial scheduled to start Feb. 1. Hendrick says it would seek a court order to prevent disclosure if Spire is required to produce the information.
