Wilber Rafael Garcés Pérez, a 28-year-old Venezuelan DoorDash driver, was shot once in Austin on Sunday while making deliveries. Reports citing DHS officials say the ICE agent who fired was hired last year and was not wearing his issued body camera.
An unnamed DHS official told The Atlantic that agents tried to stop Garcés Pérez, who allegedly drove away and nearly hit an officer; the official said another ICE agent's bodycam recorded that sequence. Garcés Pérez said officers rammed his car as he tried to park and shot him in the back of the neck. His attorney said the bullet remains in his body and he was taken from an ICE facility back to hospital after difficulty lifting his arm.
Garcés Pérez's attorney said he entered the U.S. lawfully after inspection by Customs and Border Protection, had a work permit, and received a deportation order in absentia after the hearing notice was sent to the wrong address. DHS said his work permit expired in 2025. DoorDash said it is investigating the shooting.
