Attorney General Todd Blanche said the Trump administration will immediately ask the US Supreme Court to intervene after a federal appeals court largely upheld a ruling that found its policy of deporting migrants to countries other than their own unlawful.
A three-judge panel of the 1st US Circuit Court of Appeals in Boston largely upheld a February decision declaring the Department of Homeland Security policy unlawful. The class action was brought by migrants with deportation orders and concerns due-process protections before removal to countries with which they have no connection.
Agreements made by the administration have allowed it to send more than 25,000 migrants to at least 29 third countries, often Mexico, according to Third Country Deportation Watch, a project run by Refugees International and Human Rights First. Blanche said the Supreme Court had previously granted a stay in the same case.
