After a mistrial in Lindsay Clancy’s case, her lawyer Kevin Reddington asked a judge to investigate holdout juror Michael Desronvil’s possible phone use during deliberations. Desronvil’s lawyer called it an attack on the justice system, saying Reddington was a “sore loser.”
Eleven jurors agreed on a not-guilty-by-reason-of-insanity verdict; Desronvil voted guilty. Reddington’s motion asks Judge William Sullivan to review Desronvil’s cellphone records for possible use during deliberations, along with his pretrial questionnaire and prior records. One juror alleged Desronvil scrolled on his phone; Desronvil said other jurors used phones too, and his representative alleged some posted on social media during deliberations.
The court is scheduled to reconvene on Sept. 29 to consider Reddington’s motions and next steps. Desronvil is reportedly preparing a complaint against Reddington, according to TMZ.
