Justice Ketanji Brown Jackson did not grant the Trump administration an immediate stay in its deportation-powers case. She instead called for the immigrants’ lawyers to respond by 4 p.m. ET Monday, leaving the administration’s emergency request pending.
At a Washington law school on Thursday, Jackson reportedly said she had “serious concern” that the Supreme Court’s handling of its emergency docket was having an “enormously disruptive and potentially corrosive effect” on the court system.
The administration’s filing unusually asked Jackson to refer its request for an immediate administrative stay to the full court if she was not inclined to grant it. After the lawyers respond, she may refer the longer-term stay question to all the justices; if she denies that request herself, the administration can present it to another justice to bring it before the full court.
